Action under the safe-place statute commenced by plaintiff Rudolph R. Burmek against defendant Miller Brewing Company for personal injuries sustained when plaintiff fell from the roof of a building on defendants premises. The jury found defendant failed to provide a safe place of employment with respect to lighting conditions, found plaintiff negligent with respect to his own safety and apportioned the negligence 65 per cent to defendant and 35 per cent to plaintiff. On motions after verdict the trial court modified the verdict with respect to damages, giving plaintiff the option to accept a reduced amount. Plaintiff exercised his option and judgment was entered on the verdict as amended. From that judgment defendant appeals.
